RECENT RESULTS:

BREACH OF CONTRACT - CONSTRUCTION

Successfully tried a case where a subcontractor was suing Mr. Yates’ client who was the general contractor on a large construction project. The subcontractor was claiming it was owed in excess of $100,000. Judgment was ultimately rendered in favor of Mr. Yates’ client and awarded damages to Mr. Yates’ client and nothing to the subcontractor.

WILL CONTEST - PROBATE

Successfully represented clients at trial in preventing the admission of a will to probate.

BREACH OF CONTRACT - CONSTRUCTION

Successfully represented a roofing contractor in a suit for amounts owed to roofer and defeating claims of homeowner alleging DTPA, negligence, fraud and other claims.

UNDUE INFLUENCE/SEX FOR A FEE – PROBATE AND ESTATE

Jeff represented a client in an 8-day jury trial involving an estate valued in excess of $8,000,000. Jeff’s client and her sisters fought to set aside various gifts, transfers and beneficiary designations made by their father over a 10-year period as a result of undue influence and under the theory that it constituted sex for a fee (prostitution). The jury agreed and set aside all gifts, transfers and beneficiary designations.

BREACH OF PURCHASE AGREEMENT

Jeff represented the seller who sold a company that provided anesthesia services. The buyer asserted that it was defrauded and that the seller breached the agreement. In arbitration, the arbitrator awarded Jeff’s client in excess of $200,000.

BREACH OF CONTRACT – EMPLOYMENT LAW

Jeff represented a company in a claim by a former independent contractor where the independent contractor claim he was owed in excess of $100,000 in commissions. The Judge ruled in favor of the company and awarded nothing to the independent contractor.

BREACH OF PURCHASE AGREEMENT

Jeff represented the seller who sold a company that provided home healthcare services. The buyer refused to pay a portion of the purchase price, and asserted seller breached the purchase agreement and actually owed the buyer compensation. At trial, the judge awarded the seller almost $60,000 based on buyer’s breach of the asset purchase agreement.
